These Terms of Service (“Terms”) govern your access to and use of the website, forms, SMS messaging program, and roofing services provided by Yosemite Roofing LLC (“Yosemite Roofing,” “we,” “us,” or “our”). By using our website (yosemiteroofing.com), submitting a form, requesting a quote or inspection, opting in to receive text messages from us, or engaging us for roofing services, you agree to these Terms.

If you do not agree, please discontinue use of our website and services.

You agree to use the site only for lawful purposes. You may not attempt to disrupt the site, harvest data, scrape content, submit false or misleading information through our forms, or use the site to transmit malware or spam. We may suspend or terminate access at our discretion for any conduct we believe violates these Terms.

Any estimates, quotes, images, videos, or roof visualizations provided through our site are for informational purposes only and are not binding contracts. Final scope, pricing, warranties, and terms are set out only in a written estimate or contract signed by both you and an authorized representative of Yosemite Roofing. All work is subject to on-site inspection, availability of materials, and applicable permits and codes.

Our SMS program is governed by our SMS Opt-In & Messaging Policy, which is incorporated into these Terms by reference. Key points:

• By providing your mobile number and opting in (via form, verbal consent, signed estimate, or by texting us first), you agree to receive SMS text messages from Yosemite Roofing.
• Message types include appointment confirmations, quote follow-ups, project updates, storm-response dispatch, warranty reminders, and occasional promotional offers.
• Message frequency varies. Message & data rates may apply.
• Consent is not a condition of purchasing any product or service.

4. Communications Consent

By submitting a form or providing your contact information, you consent to be contacted by Yosemite Roofing by phone, email, and/or text at the numbers and addresses you provide, including calls made using automated systems where permitted by law, for purposes related to your inquiry, service, or existing customer relationship. This consent is not required to purchase services and may be revoked as described in our SMS policy and Privacy Policy.

5. Intellectual Property

All content on this site — including text, logos, graphics, photos, videos, and the Yosemite Roofing brand — is owned by or licensed to Yosemite Roofing and is protected by U.S. and international copyright and trademark laws. 6. User Submissions

If you submit photos of your property, project details, reviews, testimonials, or other content to us (through forms, email, text, or otherwise), you grant Yosemite Roofing a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content in connection with providing services to you and, where you have given additional permission, for marketing purposes. You represent that you have the rights to submit the content.

The website and any information or tools provided on it are furnished on an “as-is” and “as-available” basis without warranties of any kind, whether express or implied. To the maximum extent permitted by law, Yosemite Roofing disclaims all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

In no event will Yosemite Roofing, its officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the website or messaging program. Nothing in these Terms limits any warranty or obligation set out in a signed roofing services contract between you and Yosemite Roofing.

• Submitting false, misleading, or fraudulent information.
• Using the site or SMS program to harass, threaten, or defame any person.
• Attempting to gain unauthorized access to our systems, accounts, or data.
• Reselling, redistributing, or scraping content, forms, or messages.
• Using our SMS program to transmit any content prohibited by the CTIA, the TCPA, our messaging provider (including the Twilio Acceptable Use Policy and Twilio’s Forbidden Message Categories for US & Canada short code, toll-free, and long-code traffic), or U.S. or Canadian carriers — including but not limited to sex/adult content, hate speech, alcohol, tobacco/vaping, firearms, cannabis or other federally illegal controlled substances, gambling, payday or high-interest loans, debt-collection or credit-repair offers, cryptocurrency and stock-alert solicitations, multi-level marketing, phishing, deceptive marketing, or public URL-shortener links designed to evade carrier filters.

Our SMS program is intended solely for U.S. recipients who are 18 years of age or older and who own or are authorized to use the mobile number provided. You agree not to opt in a number that is not yours without the account holder’s express permission. We reserve the right to suspend messaging to any number or terminate any account we reasonably believe is being used in violation of these Terms, our SMS Policy, or applicable law or carrier rules.

9. Third-Party Services

Our site and messaging program rely on third-party providers (including our SMS platform, hosting, analytics, and payment processors). Those providers have their own terms and privacy policies. We are not responsible for the practices of third-party services except as required by law.

10. Governing Law & Venue

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from or relating to these Terms, the website, or the SMS program will be brought exclusively in the state or federal courts located in Smith County, Texas, and you consent to their jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date. Continued use of our website or messaging program after changes constitutes acceptance of the revised Terms.
